Sterling Ford's insolvency solutions and specialist advisory services are provided at two different levels of service:
First, a bespoke service for larger clients and estates with more complex problems requiring a tailored solution Negotiated Settlements with or without court proceedings Sterling Ford have advised on, negotiated and successfully implemented a number of complex and/or high value settlements for UK resident and non-UK resident companies and individuals, with the settlement sums paid varying from £25,000 to in excess of £15m. Such settlements have included:High profile cases where the indviduals, directors or investors concerned require a full and final settlement to be negotiated in confidence with creditors to avoid a formal insolvency procedure, which would otherwise have bought them unwanted adverse publicity.
Negotiations and settlements with HMRC - whether in the context of an insolvency proceeding or not - with HMRC Specialist Investigations/ SI Operations, HMRC Fraud Investigation Service, Non-Resident Recovery, Counter-avoidance etc. Such negotiations and settlements have included anything from negotiating or renegotiating a time to pay/payment by instalments arrangement whether bound by a Deed of Settlement with HMRC or not, persuading HMRC to reduce their claim significantly and even to £Nil.
Tax Avoidance Schemes - Sterling Ford provide a number of services to both companies and individuals in relation to Tax Avoidance Schemes, including Disguised Remuneration Avoidance Schemes
Sterling Ford's Approach - Sterling Ford take a risk assessed approach to their negotiations in these matters to achieve settlements that both parties find acceptable.
Members' Voluntary Liquidations (MVLs) - for large and/or complex estates. Sterling Ford advise on and provide a members' voluntary liquidation service for large and/or complex estates. Sterling Ford are often consulted early on, usually by tax specialists to advise on the implementation of a particular scheme using the MVL procedure. For many such schemes, tax counsel have advised and pre-HMRC clearance for the proposed scheme has been received. Sterling Ford have provided this specialist MVL service:
- for corporate members of LLPs - including professional firms: solicitors, architects, as well as for restaurant chains and property groups
- in s110 Insolvency Act 1986 reorganisations
- for larger estates, particularly in the reorganisation of property groups, both investment and trading - with estate values from £5m to £40m+
- for estates requiring more complex in specie distributions - music publishing rights, large portfolios of regulated investments
